Terms of Service

These Terms of Service ("Terms") govern your use of the Scaleify Reviews platform and website (the "Service"), operated by Scaleify LLC("Scaleify," "we," "us"). By using the Service, you ("Client") agree to these Terms.
1. The Service
Scaleify Reviews is a software platform that enables our Client businesses to request Google reviews from, and send service-related messages to, their owncustomers, and to optimize their Google Business Profile. We send messages on the Client's behalf.
2. Client responsibility for consent
Scaleify Reviews is a platform that enables Client businesses to communicate electronically only with their own current customers who have consented to receive such communications. The Client is solely responsible for complying with all applicable laws, including the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and A2P 10DLC requirements, and for obtaining all required consents and authorizations from its customers before uploading or providing any customer contact information to the Service.
3. Consent warranty
Prior to providing any end-customer's contact information to the Service, the Client warrants that it has obtained all necessary and legally required consent to contact that customer by text message, including express written consent where required. The Client must not use the Service to contact any number on a do-not-contact list or any person who has not consented.
4. Opt-out enforcement
The Service automatically honors STOP and HELP keywords across the platform and suppresses further messages to any number that has opted out.
5. Acceptable use
You agree not to use the Service to send unlawful, deceptive, harassing, or unsolicited messages, to message purchased or third-party lists, or to violate any messaging or carrier requirements.
6. No legal advice
Scaleify LLC does not provide legal advice, and use of the Service does not guarantee compliance with applicable laws.
7. 10DLC registration authorization
Where applicable, the Client authorizes Scaleify LLC to act as its representative in the A2P 10DLC registration process.
8. Fees
Fees for the Service are as described at sign-up or in your order. Unless stated otherwise, the Service is offered on a no-contract, month-to-month basis.
9. Indemnification
The Client agrees to indemnify and hold harmless Scaleify LLC from any claims arising out of the Client's failure to comply with the TCPA, CAN-SPAM, A2P 10DLC, or any other applicable law.
10. Disclaimers & limitation of liability
The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Scaleify LLC is not liable for indirect, incidental, or consequential damages, and our total liability is limited to the fees you paid in the prior three months.
11. Changes & termination
We may update these Terms or the Service, and either party may terminate the Service consistent with the applicable order. Continued use after changes constitutes acceptance.
